    Terms of Service

    Last updated:

These terms are an agreement between you and Joseph Ellul (ABN 92 119 275 454), trading as ConsentIQ, in New South Wales, Australia ("ConsentIQ", "we", "us"), for using consentiq.tech and the ConsentIQ app. By creating an account, paying for a subscription or joining a session, you agree to these terms.

    1. What ConsentIQ is

ConsentIQ helps two adults create a clear record of what was agreed before an intimate encounter. The member starts a session. The other person (the participant) records a short video on their own phone confirming Yes or No. AI transcribes and assesses the spoken consent in the recording, and both people see the session result on screen.

    2. What ConsentIQ is not

    • It is not legal advice and it does not guarantee any legal outcome. A recording shows what was said when it was made.
    • Consent can be withdrawn at any time. If someone says no or changes their mind, stop. An earlier recording does not override a later No.
    • Consent given to one person does not extend to anyone else.
    • AI results are assessments, not findings, and may be wrong.
    • The current AI consent assessment does not verify age or perform a separate check that the spoken words match the participant's Yes or No button choice.

    3. Who can use ConsentIQ

You must be 18 or over to be a member or a participant. Age eligibility is declared, not verified by the current AI consent assessment.

    4. Rules of use

    You must not:

    • Pressure, threaten, trick or coerce anyone into recording or saying Yes.
    • Start a session with someone who is affected by alcohol or drugs to the point that they can't freely agree, or who is asleep or unconscious.
    • Use ConsentIQ with anyone under 18.
    • Use ConsentIQ to harass, shame or threaten anyone.
    • Try to access, copy or download any recording, or interfere with the service.

We may suspend or close an account that breaks these rules.

    5. Subscriptions and payment

    • Standard Access: $50 AUD per month, billed monthly.
    • Annual Access: $500 AUD per year, billed yearly.
    • ConsentIQ is not registered for GST, so no GST is charged.
    • Early Adopter Rate: the first 1,000 members keep their rate for as long as their subscription stays active. If you cancel and later rejoin, the current price applies.
    • Payments are handled by Stripe. Subscriptions renew automatically until cancelled.
    • We'll give at least 30 days' notice before any price change applies to you.

    6. Cancelling

    • You can cancel at any time from your account or by emailing joseph@consentiq.tech.
    • Your access continues until the end of the period you've paid for.
    • Recordings are kept securely while your subscription is active. When your subscription ends, your recordings and results are permanently deleted within 30 days. Resubscribe before then to keep them.
    • We don't refund part-used periods, except where the law requires it.

    7. Recordings and release

    • Recordings are held in private storage and are not publicly available.
    • Members and participants cannot view, play or download any recording. Nobody using the service has access to recordings.
    • Recordings are processed by Google Gemini for the AI checks described in our Privacy Policy.
    • We release a recording to police only after we have verified with them that it is needed.
    • We also release a recording where the law requires it, such as under a valid court order or subpoena.
    • Apart from release to police after we have verified with them that it is needed for an investigation, or legally required disclosure, we don't release recordings to members, participants, employers, clubs, institutions or the media.

    8. Your consumer rights

Nothing in these terms limits your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded under that law.

    9. Limits on our liability

To the extent the law allows, we aren't liable for the outcome of any dispute, investigation or legal proceeding, or for any decision made based on a recording or an AI result. Our total liability to you is limited to the fees you paid us in the 12 months before the claim. We aren't liable for service outages caused by events outside our reasonable control.

    10. Changes to these terms

We'll post changes on this page and email members about significant changes at least 14 days before they take effect.

    11. Governing law

These terms are governed by the laws of New South Wales, Australia, and disputes go to the courts of New South Wales.
